For all contributions on Dragonfolio China (dragonfolio.net) as well as articles in associated newsletters and membership sites the following applies:

 

I. User Agreement

 

The following agreement describes the terms and conditions applicable to you and all other people for the use of Dragonfolio China. Please read this User Agreement carefully, because by using the site, users automatically agree to be bound by these Terms. As a User, if you do not agree to be bound by this User Agreement, you must exit the site immediately. Your continued use constitutes your agreement to be bound by the terms of the User Agreement.

 

II. Representations

 

Dragonfolio China is strictly a research publisher and does not provide individual investment advice to its subscribers. The information I publish is based on my opinion plus my statistical and financial data and independent research. Although I make every effort to provide the most accurate and updated information possible, my information cannot take into consideration your personal finances and goals, and therefore is not intended to be used as a customized recommendation to buy, hold, or sell securities, or engage in any trading strategy. Such recommendations may only be made by a personal advisor or the broker you select.


Most investments involve the risk of loss. Although this service makes every effort to protect your principal, you can lose money. Therefore, it is not for all of your funds. If your goal for a certain portion of your funds is strictly capital preservation, I believe you should invest those funds in conservative.

III. Registration and conclusion of the contract


Dragonfolio China offers high-quality journalistic content from the areas of business, finance, economics, culture, and stock exchange in digital form on its Dragonfolio China websites. Parts of the content are generally freely accessible to everyone. For certain material, registration, and for other content in the premium area, payment by the customer is required. Registration is free of charge but requires a functional email address. There is no legal claim to access to the content.


To gain access to the premium area, which is subject to a fee, the customer must also have a premium membership. Premium membership requires electronic registration, which must be done using the registration form available on the Dragonfolio China websites. The data required for registration must be provided completely and truthfully by the customer.

IV. Use and obligations of the customer

The customer may only use the contents of the Dragonfolio China websites for personal needs, for their own, non-commercial purposes. This also applies expressly to parts of the content, such as individual articles, photos, or comments.

If the customer clears the suspicion, the block will be lifted. The customer must compensate Dragonfolio China for the damage resulting from its breaches of duty. The liability of the customer is limited to those cases for which he is responsible.

V. Customer content

As part of the intended use, the customer can also provide Dragonfolio China with its content and upload this content to the Dragonfolio China websites. This is typically done, but not limited to, through a comment on articles, a contribution in the forums, or a guest contribution from the customer.

The customer is prohibited from posting or uploading content that is not permitted by law or otherwise prohibited or discriminatory content. The customer is obliged to observe the usage rules of the forum as well as the rights of third parties. This applies in particular, but not limited to, the copyrights of third parties to texts, videos or images, or the right to one's image in the case of third parties depicted.

For the content posted or uploaded by the customer, the customer expressly declares that the content is correct and legally permissible. Furthermore, the customer declares to be the author of the content or to be the owner of all necessary usage rights to be able to publish or utilize the content on the Dragonfolio China websites.

For the content posted or uploaded by the customer, regardless of the type, the customer irrevocably grants Dragonfolio China the free, non-exclusive, time and space unlimited, non-exclusive right to use, reproduce, publish, distribute, modify or edit. Dragonfolio China also has the right to grant third parties usage rights to this content, and to transfer the content to other media and use it for advertising.

The customer releases Dragonfolio China from all legal and financial claims based on violations of the law through content posted or uploaded by the customer.

Dragonfolio China reserves the right to delete or delete the content posted or uploaded by the customer in whole or in part without inquiries or announcements, and to restrict access to the forum and the content.

The customer has no claim to publication of the uploaded or uploaded content, just as there is no contractual right to use the forum. VI. Prices, service provision, and payment methods

VII. Currency


All transactions (including purchases, entry fees, deposits, and withdrawals) will be denominated and expressly identified as so stated. Please be aware that the funds will be converted by the payment processors or your financial institution and you may be charged a service fee for such conversion. Dragonfolio China does not control such websites and is not responsible for their content. Just because Dragonfolio China has hyperlinks to such web sites does not mean Dragonfolio China endorses any of the material on such websites or has any association with their operators.

Users further acknowledge that use of any website controlled, owned, or operated by third parties is governed by the terms and conditions of use for those websites, and not by Dragonfolio Chinaäs User Agreement or Privacy Policy. Links to external websites or inclusions of advertisements do not constitute an endorsement by Dragonfolio China of such sites or the content, products, advertising, or other materials presented on such sites, but are for user’s convenience. Users access them at their own risk. Dagonfolio China expressly disclaims any liability for any damages whatsoever incurred by any user in connection with the use of any websites the access to which was found through this site.

 

IX. Intellectual Property Rights
 

All text, graphics, editorial content, data, formatting, graphs, HTML, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces, and other content that users see or read on this website or publicly display in any format at any venue including, but not limited to, any public presentations and/or lectures is owned by Dragonfolio China or is used with permission. This proprietary material is protected in all forms, media, and technologies now known or hereinafter developed.

 

With the exception of uses allowed, users may not copy, download, use redesign, reconfigure, or re-transmit anything from the Dragonfolio China website or through any other publicly displayed venue or presentation without Dragonfolio China's prior express written permission. Furthermore, users are not allowed to post or distribute any material they do not own, or which they do not have permission to use. Violation of this policy may result in copyright, trademark, or other intellectual property rights violations, and subject users to termination from the use of this site or civil or criminal penalties.

In addition, the website contains material protected by the domestic and international laws of copyright, patents, or other proprietary rights and laws. Any use of such proprietary material, other than as permitted herein, is expressly prohibited without the prior permission of Dragonfolio China and/or the relevant right holder.

 

X. Late payment

As soon as and as long as a customer is in default of payment, Dragonfolio China is entitled to block access to the content. If the customer does not make a timely payment, Dragonfolio China will warn the customer by setting a deadline. If the customer ignores these reminders, Dragonfolio China is free to take further appropriate legal action. In addition to the outstanding subscription fees, the customer has to bear all costs of legal proceedings (including reminder costs, costs for a collection agency, etc.). Dragonfolio China expressly reserves the right to assert further claims.

XI. Termination


Ordinary termination from the customer is excluded in the event of an agreed minimum subscription period. The minimum subscription period for paid content depends on the contract concluded (normally one year).
 

Unless otherwise agreed, subscriptions are automatically extended for the term of the contract, but for a maximum of one year, unless they are canceled at least one month before the end of the contract.
 

Dragonfolio.net is entitled to change the scope, type, and content of the services offered at any time without notice, provided that the customer is not thereby made worse by the bindingly promised services.


Dragonfolio.net is also entitled at any time to discontinue the operation of the dragonfolio.net website, to transfer it in whole or in part to third parties, to reduce or adapt legally binding benefits or to terminate the contractual relationship with the customer prematurely. In this case, remuneration paid in advance by the customer will be reimbursed pro-rata to the extent that it relates to services that have not yet been received.


The extraordinary termination is free to both parties if the legal requirements are met. Terminations must always be made in writing. When the termination takes effect, the right to use the affected content expires.

 

XII. Right of withdrawal and consequences


If you are a private consumer, you have the right to cancel a contract within 14 days without giving a reason. The cancellation period is fourteen days from the day the contract is concluded.


In order to exercise your right of cancellation, you must inform me of your decision to cancel this contract through a clear statement (e.g., by email). To meet the cancellation deadline, it is sufficient for you to send your communication regarding your exercise of the right of cancellation before the cancellation period expires.


If you cancel a contract, I will refund all payments I have received from you, including delivery costs, immediately and at the latest within fourteen days from the day on which I received notification of your cancellation of this contract. For this repayment, I use the same means of payment that you used in the original transaction unless expressly agreed otherwise with you; Under no circumstances will you be charged any fees for this repayment on our part.


Since you have immediate access to all digital content with the activation and a return of our services is therefore impossible, I can only activate this after the above withdrawal period has expired.
If you want to avoid this waiting time, you can explicitly instruct me to execute the contract immediately. In this case, your right of cancellation expires, and I will promptly activate your digital content.

XIII. Liability, warranty, and exemption

If content from dragonfolio.net is made available to the customer free of charge, dragonfolio.net is liable for its own content in accordance with the statutory provisions for gifts. A guarantee for defects is not accepted. The services provided on the dragonfolio.net websites are subject to availability and can be changed or discontinued at any time.


In the case of paid content, dragonfolio.net is liable for its content in accordance with the statutory provisions for damage to the customer that was caused intentionally or through gross negligence, the result of the non-existence of a guaranteed quality of the service item, which is based on a culpable violation of essential contractual obligations a culpable injury to health, limb or life, or for which liability is provided under the Product Liability Act.

For the rest, liability – regardless of the legal reason – is excluded both towards dragonfolio.net and towards its employees, organs, and agents.


In particular, dragonfolio.net is not liable for legal violations in transmitted, stored, or linked third-party content insofar as dragonfolio.net did not know about these legal violations. As soon as dragonfolio.net becomes aware of such violations, this content will be removed immediately.


As far as warranty claims can exist, the legal regulations apply.


The customer releases dragonfolio.net, its employees, organs, and agents from all third party claims and indemnifies them against any third-party claims that arise due to its culpable behavior or in connection with its use of the dragonfolio.net websites or directly or indirectly result from it.

 

XIV. Release


Because I am not involved in the actual contact between users, in the event that you have a dispute with one or more users, you release Dragonfolio China from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.


XV. Information Control


I do not control the information provided by other users which is made available through my system. You may find other user’s information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and practice reasonable care when using my website. Please note that there are also risks of dealing with foreign nationals, underage persons, or people acting under false pretense. I cannot be held responsible for these risks. By using this web site and continuing its use, you release Dragonfolio China from any and all claims or controversies or damages of any kind that may arise as a result of the usage of this website as so set forth in the paragraph above.
 

XVI. Changes to the terms and conditions

Dragonfolio.net reserves the right to change these terms and conditions at any time and without giving reasons, with a reasonable notice of at least two weeks. The announcement will be made by email or by publication on the dragonfolio.net websites, stating the time of entry into force.

If the customer does not object within two weeks after publication, the amended terms and conditions are deemed to have been accepted. In the announcement of the change, the importance of this period is indicated separately.

In the event of a timely objection by the customer to the changed terms and conditions, dragonfolio.net is entitled to terminate the existing contract with the customer at the time when the change comes into force.

Dragonfolio.net is particularly entitled in the event of the ineffectiveness of a condition or in the event of a change to legal regulation or the highest judicial jurisprudence to supplement or replace these terms and conditions with effect for existing contracts, provided that the customer is not made worse by the new or changed situation, than after the original condition.

XVII. Data protection

The regulations of the website's data protection regulations and privacy policies apply.

XVIII. Subsidiary agreements, written form, severability clause

No side agreements were made.

Changes and additions to this contract must be in writing. Verbal side agreements only apply if they have been confirmed in writing. This reservation of the written form can only be lifted by means of a written agreement signed by both contractual partners.

Should one of the above provisions of these general terms and conditions be wholly or partially ineffective or incomplete, the remaining provisions remain unaffected.
